Converting Commercial Property into Residential
The first option is purchasing a single property where the main premises are converted from commercial or other non-residential use to residential. This can be an office, shop, warehouse, small administrative building, or other space, provided that urban planning regulations allow for a change of use.
- Cost: at least €250,000.
- Area: the 120 m² minimum area requirement does not apply.
- Condition: the conversion to residential status must be fully completed before submitting the Golden Visa application.
The change of use can be carried out by the seller or the buyer. Before closing the deal, an engineer must verify the technical feasibility of the conversion, the legality of the building, and the documents confirming the new residential use.
Former Industrial Buildings
The €250,000 threshold can also apply to an industrial building, a part thereof, or a property containing an industrial structure. A mandatory condition: industrial activity must not have been carried out in the building for at least five years. This is confirmed by an engineer’s technical report and documents from state or tax authorities.
Protected Buildings for Restoration
The second category includes protected or historic buildings that must be fully restored or reconstructed. The minimum purchase price is €250,000, and the investment must be made in a single property. Before purchasing, it is necessary to check the building’s official status, approved restoration conditions, and estimated cost of works.
Restrictions and Usage Rules
- Rental: the property cannot be used for short-term rentals (e.g., via Airbnb) or subleased. Long-term rental is permitted.
- Usage: a property converted from commercial use cannot be used as a legal address or branch office of a company.
What to Check Before Paying a Deposit
Before signing the contract, it is necessary to obtain legal and technical opinions. It is important to confirm that the property qualifies for the €250,000 category and that the change of use or restoration can be legally completed. Ownership rights, encumbrances, permits, cadastral data, and the source of funds are also verified.
